- Field of application and acceptance of general conditions of sale
The purchase of products offered on the website www.petrusse.com (hereinafter the "Site") is subject to these General Conditions of Sale ("General Conditions of Sale").
The site allows you to order the company SAS PETRUSSE a selection of products from the Petrusse brand (hereinafter the "Product (s)") online via the Internet.
Petrusse products are exclusively intended to be sold to late natural or legal consumers, excluding any dealer or intermediary acting on behalf of a dealer. Consequently, the customer says that he acts as a final consumer and that he does not intend to resell Petrusian products for commercial purposes.
He certifies having the legal capacity to contract the commitments provided for here.
SAS PETRUSSE can update these general conditions of sale at any time. You can read at any time from the version of the General Conditions of Sale in force by going to the "General Conditions of Sale" section of the site. The general conditions of sale in force at the time of the conclusion of the sales contract are those which are opposable to you.
- Order terms
The site allows you to order the company SAS PETRUSSE a selection of products, immediately online via the Internet for withdrawal in our shops or delivery.
These general conditions of sale do not apply to special orders. For any special order, we thank you for contacting our workshop by clicking on the "Contact us" link or by sending us an email to email@example.com, Monday to Friday (excluding holidays), from 9 a.m. to 6 p.m.
- Product availability
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. Errors or modifications may exceptionally exist, especially in the case of simultaneous orders of the same product by several customers. In the event of unavailability of product after placing your order, we will inform you by e-mail as soon as possible, by proposing either to order another product presented on our site in replacement or to cancel your ordered.
SAS PETRUSSE does not incur any responsibility in the event of a stock shortage or unavailability of products for orders not yet accepted by SAS PETRUSSE.
SAS PETRUSSE reserves the right to change the products offered on the site at any time and without notice. In order to ensure better quality of service and availability of our products with all customers on the site, SAS PETRUSSE reserves the right to limit the quantity of products that may be purchased by a customer, in accordance with the provisions Applicable in this area and in particular those of article L121-11 of the Consumer Code.
- Order procedure
5.1. Product selection
At any time, you can add products to your selection by clicking on "Add to the basket", and choose to finish your purchases or continue your browsing.
You can consult your selection by flying over or by clicking on "Basket" in the menu at the top right where will appear: the photo (s) of product (s), its colors and reference (s), the (the) quantity (s) chosen, its unit price (s) and the selection subtotal. After selecting the product (s), click on "finalize the command" to start the order process.
The creation of a customer account is not required to be able to place an order on the site.
Your identifiers and passwords are strictly personal, as a result you are committed, to keep them safely and never to communicate them to third parties. In the event of loss, theft or any fraudulent use of your customer account, you agree to inform SAS PETRUSSE as soon as possible.
The Creation of an account allows you to :
- Join our loyalty program and its advantages (discount, gifts, preview, private visit, etc.);
- To modify your personal data already communicated (name, first name, birthday, etc.);
- Follow your deliveries and consult the history of your orders;
- Add or modify your delivery and billing addresses for your next orders;
- Manage your PETRUSSE newsletter subscription.
Unless otherwise provided by the customer, the data recorded by the site constitute proof of the nature, content and date of all transactions between SAS PETRUSSE and its customers. In the event of a conflict between SAS PETRUSSE and one of its customers on a transaction made on the site, the data recorded by SAS PETRUSSE is considered as valid proof of the content of the transaction, unless proven otherwise provided by the customer.
You can deactivate your account at any time and delete your data by sending an e-mail to our database manager at the following email address: firstname.lastname@example.org.
After deactivating your account, you are free to create a new account at any time.
5.3. Confirmation of the order
5.3.A) Validation of the delivery method
On the one hand, you will have to validate your delivery method and on the other hand supplement the delivery information necessary for the proper shipment of your order: Shipping country, civility, first name, last name, telephone address telephone (or the store to which You wish to withdraw your order, if the selected delivery country has stores offering this service - see the article below "8.1 Delivery and withdrawal zone").

5.3.b) Validation of the payment method and order payment
You can resume your delivery address as a billing address or enter another. You will then be invited to select a payment method and enter the related information.
You must check the accuracy of your selection before confirming your order. If all the efforts are made to ensure that the color and reason for the products whose photos are displayed on the site are faithful to the original products, variations can occur, in particular due to the technical limitations of color rendering on your IT equipment. Once finished, your order is transmitted to Petrusse for treatment.
Petrusse reserves the right not to accept an order from a customer with whom it is in dispute for a previous order, or if Petrusse considers it reasonably that this customer has violated these general conditions or that he has engaged in a fraudulent activity, or for any other legitimate reason.
5.3.c) Confirmation of the order
A summary of your order will then be sent to you by e-mail. The acknowledgment of receipt will include the total amount of the order, the information relating to the cost and the delivery time, the essential characteristics, the quantity and price of the products purchased.
We advise you to keep this acknowledgment of receipt on a paper or electronic medium.
- Price - means of payment accepted
The prices of the products are indicated in euros, all taxes included. Apart from the reimbursement cases carried out as part of the exercise of the right of withdrawal or for lack of compliance and hidden defects, Petrusse will not reimburse the VAT applied to the purchases made on the site (even in the event that the buyer , after receipt, re -expressed products for a third country to the European Union).
Petrusse reserves the right to modify at any time and without notice the prices of the products offered on the site. The products are billed on the basis of the prices displayed on the site when placing your order, subject to availability of the products ordered at this time.
All orders are payable in euros and must be paid immediately when placing your order. In the event of unavailability of certain products ordered (see article 3 "Products availability"), only the price and transport costs relating to available products will be debited.
6.2. Accepted means of payment
6.2.a) Payment by credit card or bank card
Credit cards and accepted bank cards are: Visa®, Mastercard®, American Express®. Bank card payments are authenticated and secure thanks to the Secure 3D system. This device is also known as "Verified by Visa®", "Mastercard® Securecode" or "American Express Safekey®". During payment, the bank requests personal information from the Internet user to verify the identity of the card holder and validate the transaction.
How to pay with 3D Secure on Petrusse.com?
After the validation of your bank details (card number, expiration date and cryptogram), a new page will be displayed on which you will have to enter the personal information requested by your bank. This information can be:
- The answer to a personal question;
- A password that you have chosen beforehand;
- A code sent by SMS,
- Your date of birth ...
Once the 3D Secure code has entered and validated by your bank, your order is finalized. You will then receive a confirmation email.
Authentication is specific to each bank. For any questions regarding your 3D Secure code, we invite you to contact your bank directly.
The shipment of your order only takes place after verification of your payment method and receipt of the debit authorization of your card.
The debit of your account will take place when shipping your order.
6.2.b) Payment by PayPal
We accept payments made through Paypal.
When you finish your order, if you choose the PayPal payment option, you will automatically be redirected to the PayPal platform. You will then need to log into your Paypal account. If you do not have a PayPal account, you can create one on this occasion. After validation of your order with Paypal, you will be redirected to the confirmation page of Petrusse.com.
6.2.c) Customer gift cards issued in store
Gift cards issued by Petrusse stores can be used to buy products presented on the site.
- Reserve of ownership
The products ordered remain the property of SAS PETRUSSE until the full price collection by SAS PETRUSSE.
On the other hand, you assume the risks (including loss, theft or deterioration) concerning the products delivered from the time they are delivered to the address indicated during the order.
- Delivery and withdrawal terms
8.1. Delivery and withdrawal area
8.1.A) Delivery to a postal address
The products are shipped to the delivery address you indicated during the order process.
8.1.b) Removal in Petrusse store
You can remove your order from the site in Petrusse store on the site. This service, offered to site customers, is currently only offered in our stores in France: 8 allées de Tourny 33000 Bordeaux and 46 boulevard Raspail 75007 Paris.
You can designate another person for the withdrawal of your order in store (see "8.3 delivery and withdrawal times").
8.2. Shipping cost
The amount of delivery costs is calculated according to the products chosen, the total value of your order as well as the delivery method chosen.
Orders delivered in France are Franco de Port from 180 €. Orders delivered in France less than € 180 and for any amount outside of mainland France will be increased by the costs of participation for the preparation and shipping of your order.
Delivery is provided by LaPoste or DHL services, from Monday to Saturday, depending on the option chosen by the customer at the validation of their order.
8.3. Delivery and withdrawal times
The delivery times below run from the validation of your order.
8.3.A) Delivery to a postal address
Your package is shipped within 2 working days.
Additional delivery times are those practiced by our carrier (2 to 8 days depending on the delivery country). PETRUSSE cannot be held responsible for the consequences due to a delay in delivery from the carrier.
In addition, any defect or delay in delivery higher than eight working days must be reported to our customer service as soon as possible. Any complaint made beyond thirty calendar days after the date of validation of your order cannot be taken into account.
At the time of delivery, you must check the compliance of the goods and indicate, if possible on the delivery slip, in the form of handwritten reserves accompanied by your signature any anomalies observed (open package, damaged product etc.). You must then contact customer service by email or by phone to keep it informed.
8.3.b) Removal in store
An e-mail will be sent to you when your order is available in store.
Except in special cases (personalization, etc.) and cases of force majeure, your products will be available for a withdrawal from a Petrusse store in France within two (2) working days.
In order to recover your order, please present a seller when you arrive in store, with:
- E-mail informing you of the availability of your order (printed or on the screen of your phone);
- And your identity document.
If you have chosen a withdrawal by another person, the latter will have to present a seller with:
- the email informing the availability of the order, which you will have beforehand transferred;
- A written proxy on your part giving it the right to recover your order;
- a copy of his identity document;
- And your identity document.
You have fourteen (14) working days to recover your order, from the reception of the email informing you of its availability in store. Otherwise, SAS PETRUSSE reserves the right to reimburse the order.
- Delivery problems
Any defect or delay in delivery, or provision of your products in stores, higher than the delivery times mentioned in article 8.3 must be reported to our customer service as soon as possible. Any complaint made beyond thirty (30) calendar days after the date of validation of your order cannot be taken into account.
In the event of non-compliance with the delivery time, you can cancel the order, simply by e-mail at email@example.com or registered letter at the following address:

Petrusse will then be required to reimburse you all the sums paid, at the latest within thirty (30) days of the date of denunciation of the sales contract. If you receive the product, however, after using this faculty, you will have to return it according to the return terms provided for in article 11 below.
You must check the compliance of the products at the time of delivery and indicate, if possible on the delivery slip, in the form of handwritten reserves accompanied by your signature any anomalies observed (open package, damaged product etc.).

- Right to retract
10.1. Right and withdrawal
Except for personalized products at your request, you have a legal right of withdrawal that you can exercise under the conditions provided for in the articles L221-18 and L221-20 of the Consumer Code, if you meet the conditions laid by these provisions, without having to justify reasons and without having to pay penalties.
The general return policy (for request for reimbursement or exchange) of SAS PETRUSSE allows you to withdraw within fourteen days from the date of delivery of the products, without having to justify reasons and without having to pay penalty. After this period, you will no longer be able to exercise your right of withdrawal.
10.2. Procedures for exercising the right of withdrawal
We offer you the possibility of filling out and transmitting your online withdrawal declaration by logging into your customer account. You will then immediately receive confirmation of your withdrawal by email.
You can also, before the expiration of the 14-day retraction period mentioned above, send any other declaration devoid of ambiguity expressing your desire to withdraw to the following address:

10.3. Consequence of the right of withdrawal

The refund of items is carried out no later than 30 days after receiving the package via the same means of payment as that used to place your order.
Only the return costs will be imputed to you except in the event of defective items for which an exchange will be made.

11.2. With Petrusian stores
Any product, purchased or received as a gift from the site, delivered to your home or withdrawn in store, can be exchanged or be the subject of a credit card valid six months in Petrusse stores in the fourteen calendar days according to the Delivery date, under the following conditions:
- The products returned or returned must be in their original condition and packaging;

- After sales service

- Limitation of liability
In any case, the responsibility of SAS PETRUSSE can be engaged for any damage which would not result from a breach of SAS PETRUSSE in one of its obligations.
- Applicable law - Disputes
These general conditions of sale are governed and interpreted in accordance with French law without taking into account the principles of conflict of laws.
In the event of a dispute arising from the contractual relationship, the Customer can file a written complaint with the Customer Service at firstname.lastname@example.org. If the complaint is not resolved amicably by the Customer Service and within a period of one (1) year, the Customer may use the free mediation service CM2C, to which SAS Petrusse is a member, electronically at email@example.com or by postal mail: CM2C - 14 rue Saint Jean - 75017 Paris, in accordance with Article L. 612-1 of the French Consumer Code. The dispute may also be resolved through legal action. The parties agree that any dispute arising from this contract shall be under the exclusive jurisdiction of the courts of Bordeaux (FRANCE).
